工程條款

1. 工作範圍及服務標準

1a. 本公司將按報價單及雙方確認之工作範圍,提供噴畫輸出、安裝及/或相關工程服務。

1b. 所有服務將按行業一般合理標準及專業方式完成,而非以主觀審美或絕對完美作為衡量標準。

 

2. 圖稿、顏色及輸出說明

2a. 客戶須提供最終確認之圖稿(包括尺寸、內容及出血位)。

2b. 圖稿一經確認並開始生產,恕不接受更改或退款。

2 c. 由於顯示器、物料及輸出方式不同,成品顏色與電子檔或樣本之間可能存在合理色差,屬正常情況。

2d. 其他噴畫印刷標準可參考本公司印刷生產條款

 

3. 尺寸、現場測量及資料責任

3a. 如尺寸或施工資料由客戶提供或事前量度為準,如場地有任何變更需由客戶自行負責。

3b. 如由本公司進行現場測量,將以當日可見及可施工情況作出合理量度;如其後因場地結構、管理處限制或其他不可預見因素需作調整,相關安排將另行協商。

 

4. 現場條件及第三方限制

4a. 客戶須確保施工期間場地已獲管理處/主辦方批准,並提供必要之進出安排、施工時間、電力、升降設備及相關配合。

4b. 如因場地管理、第三方承建商、主辦方安排或其他非本公司可控制之因素而導致延誤、等候或未能即時施工,工期將相應順延,並可能產生額外費用。

4c. 正常裝裱工程客戶需提供已清潔平滑表面以供拖工,如特別表面可事前協商或需按需另收清潔費用。

4d. 所有工程費用以可直接停車場至現場可以合適搬運工具為準,如需額外人手搬運則可能需另報價。

 

5. 變更(Variation)

5a. 任何有關尺寸、物料、數量、安裝位置、施工時間或方式之更改,須經客戶事先確認。

5b. 所有變更所產生之額外費用及/或工期調整,將另行報價並需客戶確認後方會執行。

 

6. 工期及延誤

6a. 報價中所列之施工日期或完成時間屬預計安排。

6b. 如因有影響性天氣、場地限制、管理處安排、第三方因素或客戶延遲提供資料而導致延誤,本公司不構成違約,工期將相應順延。

 

7. 價格、付款及取消

7a. 除另有約定外,客戶須按報價單所列付款安排支付訂金及尾數。

7b. 如工程於生產或施工前被取消,已產生之設計、輸出、物料、人工或其他相關成本將不獲退還。

7c. 如於施工期間取消或暫停工程,客戶須承擔已完成及已安排之工作費用。

 

8. 安全及保險

8a. 本公司將按香港法例要求,為其僱員安排相關保險。

8b. 客戶須確保施工場地之結構及環境安全,並對其場地、展品或第三方物品負責。

8c. 如場地或施工環境被合理判斷為不安全,本公司有權暫停或拒絕施工,直至相關風險獲妥善處理。

 

9. 損毀、責任及賠償

9a. 在法律容許範圍內,本公司僅就因其疏忽直接引致之實際損失承擔責任。

9b. 本公司不就任何間接、相應、營業、利潤或推廣效果相關之損失負責。

9c. 本公司於任何情況下之最高責任,以該項工程實際收取之費用總額為上限。

 

10. 驗收、保養及缺陷

10a. 完成安裝服務或收到產品後,請立即進行當場檢查並簽署確認。若離開後有任何問題,可能無法進行後續處理。

10b. 如成品或安裝在合理時間內出現因施工問題引致之缺陷,客戶須盡快通知本公司作出合理跟進。

10c. 因正常損耗、天氣、第三方改動或客戶自行處理所引致之問題,不屬保養範圍。

 

11. 終止及拒絕施工

11a如客戶要求之工作涉及違反法例、場地規則或存在安全風險,本公司有權拒絕或終止相關工作,而不構成違約。

 

12. 適用法律及爭議處理

12a本條款受香港特別行政區法律管轄,如有爭議,雙方應先以友好方式協商解決,未能解決時,可按香港法律處理。

Terms and Conditions for Printing and Advertising Engineering Services

(Applicable to large format printing, banner installation, site decoration and exhibition-related works)

 

1. Scope of Work and Service Standard

1.1 The Company shall provide large format printing, installation and/or related engineering services in accordance with the quotation and the scope of work confirmed by both parties.

1.2 All services shall be carried out in a professional manner and in accordance with general industry standards, and shall not be assessed based on subjective aesthetic judgment or absolute perfection.

 

2. Artwork, Colour and Printing Specifications

2.1 The Client shall provide final confirmed artwork, including dimensions, content and bleed requirements.

2.2 Once the artwork is confirmed and production has commenced, no changes, cancellations or refunds shall be accepted.

2.3 Due to differences in display devices, materials and printing methods, reasonable colour variation between the final product and digital files or samples is normal and acceptable.

2.4 Other printing standards and specifications shall be subject to the Company’s printing production terms.

 

3. Dimensions, Site Measurement and Information Responsibility

3.1 Where dimensions or installation details are provided by the Client or based on prior measurements, the Client shall be solely responsible for their accuracy. Any subsequent changes to site conditions shall be borne by the Client.

3.2 Where on-site measurement is conducted by the Company, measurements shall be taken based on visible and workable conditions at the time. Any adjustment required due to site structure, management restrictions or other unforeseeable circumstances shall be subject to further discussion and arrangement.

 

4. Site Conditions and Third-Party Restrictions

4.1 The Client shall ensure that all necessary approvals from venue management and/or event organisers are obtained prior to installation, and shall provide appropriate site access, working hours, power supply, lifting facilities and necessary cooperation.

4.2 Any delay, waiting time or inability to proceed with installation caused by venue management, third-party contractors, organisers or other factors beyond the Company’s control shall result in a corresponding extension of the schedule and may incur additional charges.

4.3 For standard mounting works, the Client shall provide a clean and smooth surface. Special surfaces shall be subject to prior agreement or may require additional cleaning charges.

4.4 All quoted prices are based on direct access from a legal parking area to the installation site using suitable handling equipment. Additional manpower or handling requirements may result in additional charges.

 

5. Variations

5.1 Any changes relating to dimensions, materials, quantities, installation location, working time or methods must be confirmed by the Client in advance.

5.2 Any additional costs and/or schedule adjustments arising from such variations shall be quoted separately and shall only be executed upon Client confirmation.

 

6. Schedule and Delays

6.1 Any installation date or completion time stated in the quotation is an estimated arrangement only.

6.2 The Company shall not be liable for delays caused by adverse weather conditions, site restrictions, venue management arrangements, third-party factors or the Client’s delay in providing information, and the schedule shall be extended accordingly.

 

7. Pricing, Payment and Cancellation

7.1 Unless otherwise agreed, the Client shall make payment in accordance with the payment terms stated in the quotation, including deposit and balance.

7.2 If the project is cancelled prior to production or installation, all costs already incurred, including design, printing, materials, labour and related expenses, shall be non-refundable.

7.3 If the project is cancelled or suspended during installation, the Client shall be responsible for all completed works and pre-arranged costs.

 

8. Safety and Insurance

8.1 The Company shall arrange appropriate insurance coverage for its employees in accordance with Hong Kong legal requirements.

8.2 The Client shall ensure the structural integrity and safety of the installation site and shall be responsible for its premises, exhibits and third-party properties.

8.3 Where the site or working environment is reasonably deemed unsafe, the Company reserves the right to suspend or refuse work until the relevant risks have been properly addressed.

 

9. Damage, Liability and Compensation

9.1 To the extent permitted by law, the Company shall only be liable for direct losses arising from its proven negligence.

9.2 The Company shall not be liable for any indirect, consequential, business, profit or promotional-related losses.

9.3 In any event, the Company’s maximum liability shall be limited to the total amount actually received for the relevant project.

 

10. Inspection, Warranty and Defects

10.1 Upon completion of installation or receipt of products, the Client shall conduct immediate on-site inspection and sign confirmation. Issues reported after departure may not be accepted for further handling.

10.2 Where defects arising from workmanship are identified within a reasonable time, the Client shall notify the Company promptly for reasonable follow-up action.

10.3 Defects caused by normal wear and tear, weather conditions, third-party interference or Client’s own handling are excluded from warranty coverage.

 

11. Termination and Refusal of Work

11.1 Where the Client requests work that violates applicable laws, venue regulations or presents safety risks, the Company reserves the right to refuse or terminate such work without constituting a breach of contract.

12. Governing Law and Dispute Resolution

12.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

12.2 In the event of any dispute, both parties shall first attempt to resolve the matter amicably. Failing such resolution, the dispute shall be handled in accordance with Hong Kong law.
